Human rights are founded on principles such as dignity, fairness and respect. They will protect you every day, regardless of where you live or how you choose to live it.

The European Convention on Human Rights is a protection for the human rights of citizens of countries that are members of the Council of Europe. This includes the UK. The Council of Europe differs from the European Union.

What are the UK’s human rights?

The Human Rights Act 1998 in the UK protects human rights. This Act applies the European Convention on Human Rights rights. These rights are known as Convention rights.

You can bring a case under the Human Rights Act to the UK courts if your Convention or human rights are being violated. You can sometimes also appeal to the European Court of Human Rights.

What is the European Court of Human Rights (ECHR)?

The European Court of Human Rights, also known as the European Court of Human Rights, is the Court of the Council of Europe. It is based in Strasbourg in France. It ensures that the Council of Europe countries, including the UK, adhere to the European Convention on Human Rights. You may be eligible to bring your case to Strasbourg if your human rights are being violated and you have not been able get a remedy from the UK.

What is the best time to take a case before the European Court of Human Rights.

If you have not been able or are unable to obtain a remedy in the UK, you can file a complaint with the European Court of Human Rights.

For example, this is true if:

You have been denied leave to appeal to the judiciary. This means that you are not allowed to submit a judicial review application.

You have been denied the right to appeal the decision to the Court of Appeal/Supreme Court

A final appeal was made.

If a UK court declares incompatibility with a law, but Parliament refuses to amend it, you can also bring a case to European Court of Human Rights.

What is the Universal Declaration of Human Rights (UDHR)?

Human rights can be found in many places. There are many international instruments or documents that apply worldwide to human rights, including the European Convention on Human Rights.

After the Second World War, the United Nations adopted the Universal Declaration of Human Rights.
